These Terms of Service ("Terms") govern your use of the websites, products, and services provided by Baasa Cloud ("we", "us", "our"). By creating an account or using any of our services, you agree to be bound by these Terms.
1. Account and eligibility
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to create an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
2. Acceptable use
You agree not to use our services to host, transmit, or distribute content that is illegal, harmful, defamatory, infringing on intellectual property, or that disrupts our infrastructure or other customers. This includes but is not limited to:
- Spam, phishing, or unsolicited bulk email
- Malware, viruses, or hacking tools
- Cryptocurrency mining on shared hosting
- Content that violates Ugandan or international law
3. Service availability
We target a 99.9% monthly uptime on all hosting services. If we fail to meet this, you may request a pro-rated credit on your next invoice. Planned maintenance is announced at least 48 hours in advance whenever possible.
4. Payment and refunds
All prices are listed in Ugandan Shillings (UGX) unless otherwise specified. Payments are due in advance of each billing period. We offer a 45 day money-back guarantee on new shared hosting subscriptions. Domain registrations, renewals, and one-time web design fees are non-refundable, as required by ICANN and the nature of the work involved.
5. Renewals and cancellations
Hosting and domain services renew automatically unless cancelled. You may cancel auto-renewal at any time from your client area. If a renewal payment fails, we will retry for up to 30 days before suspending the service.
6. Backups
We take daily off-server backups and retain them for 30 days. While we make every effort to keep backups intact, customers are responsible for maintaining their own copies of critical data.
7. Domain registrations
Domains are registered through accredited registrars and are subject to the rules of the relevant registry and ICANN. You are the legal registrant of any domain you register through us.
8. Limitation of liability
Our total liability for any claim arising from these Terms or your use of our services is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages.
9. Changes to these Terms
We may update these Terms from time to time. Material changes are announced by email or via the client area at least 30 days before they take effect.
10. Governing law
These Terms are governed by the laws of Uganda. Any dispute will be resolved in the courts of Kampala, Uganda.
